1. Purpose and acceptance
These Terms of Use ("Terms") govern access to and use of the Tales of the Galaxy site (talesofthegalaxy.com), hereinafter "the Platform", published by Aïssa Bovet (canton of Vaud, Switzerland), hereinafter "the Publisher".
Access to and use of the Platform constitute full, unreserved acceptance of these Terms. Any user who does not accept all or part of the Terms must immediately cease using the Platform.
The Publisher may modify the Terms at any time. The applicable version is the one in force on the day of use of the Platform.
2. Access conditions — Adults-only Platform (18+)
The Platform is strictly reserved for persons aged 18 years or older. Published content may include erotic scenes, descriptions of narrative violence, and mature themes.
Accessing the site implies certifying your adult status via the warning banner. Creating an account additionally requires an explicit declaration of adult status (dedicated checkbox). Any false declaration engages the sole responsibility of the user. The Publisher reserves the right to suspend or delete any account whose minority would be brought to its attention.
3. User account
- Registration is free and requires a functional email address (to receive technical messages: account verification, password reset). An alias or a disposable address is acceptable, provided it remains accessible to the user.
- The username (pseudonym) and display name may be entirely fictional; the user is not required to use their real civil identity.
- The user undertakes to keep their credentials confidential and is responsible for any use made from their account.
- Each user may hold only one account.
- The user may delete their account at any time from their personal area.
- The Publisher may suspend or terminate any account in case of breach of these Terms, without notice or compensation, subject to any applicable legal rights of the user.
4. User-generated content ("Content")
Users may publish stories, series, illustrations, audio and video files (collectively, "Content"). The user represents and warrants:
- that they are the original author of the Content or hold all necessary rights for its publication;
- that the Content does not infringe third-party rights (copyright, neighbouring rights, image rights, privacy, etc.);
- that the Content complies with the prohibited-content list set out in section 6.
5. Licence granted by the user to the Platform
By submitting Content on the Platform, the user grants the Publisher, for the legal duration of copyright protection, a non-exclusive, worldwide, royalty-free, irrevocable, transferable and sub-licensable licence to reproduce, perform, adapt, translate, modify, distribute and exploit, in whole or in part, said Content, including for commercial purposes and in any existing or future media (including, without limitation: website, mobile applications, video games, printed media, derivative audiovisual works, merchandise).
This licence expressly includes the Publisher's right to integrate the Content into the Tales of the Galaxy universe, to create derivative works from it and to exploit it commercially, with no additional remuneration owed to the user.
Irrevocability for engaged exploitations. This licence is irrevocable with respect to any Content that has been integrated, incorporated, adapted or otherwise used by the Publisher in a derivative work (including: video games, audiovisual works, printed publications, merchandise, narrative content of a commercialised universe). No subsequent action by the user — licence revocation, account deletion, withdrawal of commercial opt-in, withdrawal of canon status, request for erasure ("right to be forgotten") or exercise of any other personal right — may affect, suspend or terminate the pre-existing, ongoing or planned exploitations of derivative works already produced by the Publisher or its successors-in-title. The Publisher retains the perpetual right to continue, reproduce, distribute and commercialise the relevant derivative works, by any means and on any medium, without any further authorisation being required.
Conversely, the user may at any time request the removal from the Platform of Content that has not (yet) been incorporated into a derivative work; such removal terminates the public distribution of the Content on the Platform but does not affect any pre-existing derivative exploitations.
The user retains authorship and the moral rights attached to their Content. They may request to be credited under their pseudonym in commercialised derivative works, upon request addressed to the Publisher.
6. Restriction concerning the Tales of the Galaxy universe
The Tales of the Galaxy universe, its trademark, canon characters, terminology, visual identity and proprietary fictional elements are the exclusive property of the Publisher. The user may not exploit these elements outside the Platform — including through independent publication, self-publishing, sale, adaptation, or commercial derivatives — without the Publisher's prior written authorisation.
Stories published by the user belong to them; however, the universe in which they are set does not. This restriction remains applicable even after deletion of the user's account.
7. Prohibited content
The following are strictly prohibited on the Platform:
- any content depicting minors in a sexual or suggestive context;
- any content inciting hatred, discrimination or real-world violence against a person or group;
- any content advocating criminal offences, terrorism or real violence;
- any content infringing third-party rights (counterfeiting, invasion of privacy, defamation, etc.);
- any unauthorised advertising, spam or phishing attempt.
Are expressly permitted, within the assumed 18+ nature of the Platform: erotic scenes between consenting adults, fictional narrative violence, dark or disturbing themes proper to science-fiction storytelling.
8. Moderation and reporting
The Publisher acts as a host for User-generated Content and is under no general obligation to monitor publications.
The Publisher reserves the right, at its sole discretion, to carry out occasional checks, before or after publication, on all or part of the Content. The exercise or non-exercise of this option shall not constitute a contractual undertaking nor transfer editorial responsibility for the Content to the Publisher, which remains exclusively with the author.
- any user may report content deemed illegal via the reporting form provided or by email to contact@talesofthegalaxy.com;
- the Publisher undertakes to remove promptly, without delay, any manifestly illegal content brought to its attention;
- the Publisher may, at any time and without notice, remove or make inaccessible any Content that breaches these Terms.
9. Sanctions
Failure to comply with these Terms may result, depending on severity, in: warning, temporary account suspension, removal of Content, permanent account suspension, and, where appropriate, civil or criminal proceedings.
10. Personal data
The processing of personal data is described in the Privacy Policy.
11. Limitation of liability
The Platform is provided "as is". The Publisher endeavours to ensure its availability but cannot guarantee the complete absence of interruption, error or data loss. The Publisher is not responsible for Content published by users; its liability is limited to the host's regime (removal upon notification).
12. Governing law and jurisdiction
These Terms are governed by Swiss law. Any dispute falls under the exclusive jurisdiction of the courts of the canton of Vaud, subject to the mandatory consumer-protection provisions applicable at the user's place of residence.
